1. Data Controller and General Information
Pursuant to the Law No. 6698 on the Protection of Personal Data ("KVKK"), your personal data will, in our capacity as data controller, be recorded, stored, updated, disclosed to third parties where permitted by legislation, classified and otherwise processed in the manners set out in the KVKK, by Cloud Technology Informatics Services Trade Inc. ("VEU" or the "Company"), with MERSIS number 0547054376400001 and registered address Sultan Selim Mah. NEF 09 Plaza 4. Levent B Block No:7/121 34415 Kagithane – Istanbul / Turkey. We would like to inform you about the processing of your personal data via WhatsApp.
Since any data you may communicate to our Company — within the scope of the mobile application named WhatsApp and of any conversations and correspondence that may take place after a message is sent to you through this application — that can be associated with you qualifies as personal data, your personal data will be processed by our Company in its capacity as data controller for the purposes of regulating all commercial and legal relations between you and our Company; ensuring that our customer relations activities are carried out in accordance with our Company procedures and/or the applicable legislation; fulfilling the requirements of your contracts and instructions; discharging our obligations arising from the relevant legislation; and for other similar purposes.
2. Legal Grounds for Processing
The legal grounds for the processing of your personal data under Article 5/2 of the KVKK are as follows:
- It is necessary to process the personal data of the parties to a contract, provided that it is directly related to the establishment or performance of that contract (Art. 5/2-c),
- The data has been made public by the data subject themselves (Art. 5/2-d),
- Data processing is mandatory for the establishment, exercise or protection of a right (Art. 5/2-e),
- Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject (Art. 5/2-f).
3. Transfer and Transfer Abroad
Your processed personal data will be shared abroad in accordance with Article 9 of the KVKK, because the headquarters and data storage locations of the application named WhatsApp are located abroad. In addition, your processed personal data may be transferred, for the above purposes, to public authorities stipulated by legislation, to our shareholders, affiliates and business partners in Turkey and abroad, and to other real and legal persons, in accordance with Article 8 (on the transfer of personal data) and Article 9 (on the transfer of personal data abroad) of Law No. 6698.
4. Method of Collection
Your personal data may be obtained through automatic and non-automatic means, via the correspondence you conduct with our Company over WhatsApp and any other correspondence and conversations that may take place with you in connection with such correspondence.
5. Retention Period
Your personal data may be retained for the periods required by the purposes for which they are processed. Where no other justification or legal ground exists, no international law or regulation so requires, and the obligations arising from contracts have ceased, your personal data whose processing purposes have ceased are deleted, destroyed or anonymized.
6. Rights of the Data Subject
By applying to our Company, you may exercise the following rights:
- To learn whether your personal data are being processed,
- To request information if your personal data have been processed,
- To learn the purpose of processing your personal data and whether they are used in accordance with that purpose,
- To learn the third parties to whom your personal data are transferred, in Turkey or abroad,
- To request the rectification of your personal data if they are processed incompletely or inaccurately,
- To request the deletion or destruction of your personal data within the conditions set out in Article 7 of Law No. 6698,
- To request that third parties to whom your personal data have been transferred be informed of the deletion or destruction of your personal data,
- To object to the emergence of a result against you by means of analyzing your processed personal data exclusively through automated systems,
- To request the compensation of damages in the event that you suffer damage due to the unlawful processing of your personal data.
7. Application
You may submit your requests regarding the above-mentioned rights to our Company by filling out the Contact Form. Depending on the nature of your request, your applications will be finalized free of charge as soon as possible and no later than within thirty days; however, if the process requires an additional cost, a fee may be charged according to the tariff to be determined by the Personal Data Protection Board.
